Advocate Mshololo has discredited the phone call evidence presented by the state’s fourth witness. Colonel Lambertus Steyn.
About a week ago, South Africans were stunned when Steyn presented what he called evidence to show that Kelly Khumalo was in phone contact twice with one of the accused. The first contact was reportedly months and the second contact was just 15 days before he was killed.
The Bafan Bafan goalie has been shot dead in Kelly Khumalo’s family home in Vosloorus, with Kelly, her sister Zandie, their mother and others presently. It was initially claimed that the musician was killed in a botched robbery. But that has since been disproved.
Reacting to Steyn’s evidence, Zandile Mshololo dismissed it in court and was able to prove that it wasn’t Kelly’s phone that called the fifth suspect, Fisokuhle Ntuli. Steyn would later agree that the phone numbers were used interchangeably on 2 August, 15 August and 26 October 2014.
Zandile Mshololo: When I asked you if you regard yourself as an expert or a witness, you didn't tell this court that you were declared by the court why not
Steyn: it's just my personality

The case was reassigned to a new judge after the previous judge, Maumela, was suspended by President Cyril Ramaphosa. The previous trial was also cancelled and a retrial was initiated. The suspects were also told they could apply for bail.
Kelly Khumalo has maintained her innocence in Swnzo’s death and claimed at some point that he is the only man she has ever loved.
